Federal Safety Recall Fraud and Vehicle Endangerment Report Vehicle: 2022 Hyundai Elantra Blue Hybrid | Involved Dealerships: Earnhardt Hyundai North Scottsdale & Larry H. Miller Hyundai Peoria This complaint documents severe federal safety recall fraud and mechanical endangerment by authorized manufacturer franchise dealerships. In April 2025, Earnhardt Hyundai took physical possession of my vehicle for a federally mandated Hydraulic Electronic Control Unit (HCU) braking/cruise control safety recall. Staff verbally verified the recall was complete, but the physical invoice and subsequent written email admission from Service Drive Manager [XXX] confirmed the safety repair was completely omitted with "no excuse."To resolve this braking risk, on April 22, 2026, I brought the vehicle to Larry H. Miller Hyundai Peoria to have the uncompleted HCU safety recall corrected. Subsequently, on June 17, 2026, I returned to the Peoria facility for a warranty deck lid repair and a scheduled oil change.Upon releasing the vehicle on June 17, the Peoria service department actively jeopardized my hybrid engine integrity by installing an incorrect, out-of-spec oil fluid weight (5W30) and releasing the vehicle with a completely loose, unsealed engine oil cap. This gross negligence forced me into a dangerous 140-mile high-altitude mountain highway transit ([XXX] to Flagstaff) with a compromised engine bay, creating an immediate engine fire hazard and risk of sudden highway power failure. The loose cap and incorrect fluid were independently verified and caught on video by Milestone Auto Repair in Flagstaff.The manufacturer's franchise network is falsifying federally mandated safety recall records and releasing vehicles in life-threatening, non-compliant conditions. I had just drove back home from work and I was driving to pick up my child from his basketball game. I was able to pull out of my driveway and get through two stop signs before I came to a third and needed to make a left hand turn. I stopped and let the cars from the highway pass until it was my turn to go. I was proceeding through the sign and started to turn and in the middle of the turn my vehicle cuts off acceleration and stops moving in the middle of the street and turn. No lights. No warning. Just loses power. I pressed the gas and my rpm’s just reved extremely high. I couldn’t move out of the middle of the street. I pressed the gas again and the car started moving approximately 5-10 mph. Luckily the car driving by didn’t hit me as I was sitting in the middle of the road. I finally got to the side of the road and put the vehicle into park for a couple minutes and tried to take off again. I couldn’t go faster than 5mph at this time. I had to drive back home and by the time I got back I had lost reverse capabilities. Dealer said no recalls and mechanics said not much they can do because there isn’t a code or light on for them to check. I just have a new car that doesn’t drive or go into reverse. I’m going to the original dealer to see if they can help now. I believe this is possibly the transmission but I am not sure.

All of the following has occurred to me; Delayed or sluggish acceleration Gear slips Shaking, shuddering, or juddering Harsh or rough shifts Immobility or stalling Thumping and other objectional sounds My car has just over 25000 miles. I have only had it serviced at the dealership. I have complained about this issue to only get a software reset which. Doesn’t solve the issue. The last time I left it at the dealership for this issue , they had it for weeks , was told that the issue was replicated , only got a software reset. My problem persist and only seems to be getting worse.

The contact owns a 2022 Hyundai Elantra. The contact stated that while driving at 45 MPH, she accidentally touched the gear shifter and shifted the vehicle into neutral(N). The contact was unaware that the vehicle had shifted into neutral(N) as the vehicle failed to accelerate upon depression of the accelerator pedal. After experiencing the failure, she tested the gear shifter and discovered that she was able to shift gears functions without depressing the brake pedal. The contact called a dealer and made an appointment to have the vehicle diagnosed. The manufacturer had yet to be notified of the failure. The vehicle had yet to be repaired. The failure mileage was approximately 15,000.
