The contact owns a 2016 Nissan Rogue. The contact stated that while driving at various speeds, the vehicle would stall upon the depression of the accelerator pedal without warning. The contact had taken the vehicle to an unknown dealer where they found no defect with the vehicle. The contact then stated that while making a left turn, the vehicle stalled in traffic and was hit by another vehicle. The air bags deployed upon impact. The contact suffered burns from the air bags as well as minor bruising to various parts of her body. The whereabouts of the other driver were unknown. The contact was uncertain if a police report was filed. The vehicle was towed to an independent mechanic where it remained in their possession. The manufacturer was notified about the failure but offered no assistance. The vehicle had yet to be repaired or deemed destroyed. The failure mileage was approximately 100,000.

TL* THE CONTACT OWNS A 2016 NISSAN ROGUE. THE CONTACT STATED THAT SINCE OWNING THE VEHICLE, HE HAD EXPERIENCED VARIOUS OF SAFETY FAILURES. THE CONTACT STATED THAT THE TAILGATE DOOR AND FUEL TANK WOULD OPEN INDEPENDENTLY WHILE PARKED AND NOT IN OPERATION. THE CONTACT ALSO STATED THAT ONE DAY WHILE THE VEHICLE WAS PARKED IN HIS DRIVEWAY. THE VEHICLE SLIPPED OUT OF PARK, ROLLED DOWN A HILL, AND HIT A TREE IN HIS YARD. THE AIR BAGS DID NOT DEPLOY UPON IMPACT. A POLICE REPORT WAS NOT FILED AND NO INJURIES OCCURRED AS A RESULT OF THE FAILURE. THE CONTACT INITIALLY CALLED RON MARHOFER NISSAN(247 HOWE AVE, CUYAHOGA FALLS, OH 44221) WHERE THEY REFERRED HIM TO THE MANUFACTURER. ONCE THE CONTACT CALLED THE MANUFACTURER, THEY INFORMED HIM THAT THEY WOULD SEND AN INVESTIGATOR TO HIS LOCAL DEALER TO HAVE THE VEHICLE INSPECTED. THE CONTACT THEN TOOK THE VEHICLE TO GRAND BLANC NISSAN(8346 HOLLY RD, GRAND BLANC, MI 48439) WHERE THE INSPECTOR INFORMED HIM THAT THEY FOUND NO DEFECTS WITH THE VEHICLE. THE VEHICLE HAD YET TO BE REPAIRED. THE FAILURE MILEAGE WAS 37,000.*DT THIS IS CORRESPONDENCE TO NISSAN. NISSAN INSPECTED CAR BUT COULD NOT FIND A PROBLEM NOR DUPLICATE THE OCCURRANCE THEREFORE THEY SAID WAS NOT A PROBLEM WITH VEHICLE AND THEY WOULD DO NOTHING. NISSAN WOULD NOT LET ME WATCH AS THEY INSPECTED VEHICLE NOR WOULD THEY GIVE ME COPY OF THE REPORT. THEY SAID THE REPORT WAS PROPRIETARY. I DISAGREE. I FOUND OUT 34000 OF THIS MODEL WAS RECALLED FOR THIS SAME PROBLEM THE YEAR BEFORE IN 2015. SEE ATTACHMENTS. *JB*JB
