RE: Colorado State Patrol Case #[XXX] Fremont County Case #[XXX] Agency ORI #[XXX] VIN #[XXX] NHTSA SAFETY RECALL #18V332000 (May 23, 2018) Also referred to as #U61 Dodge Ram Campaign #U53 (October 1, 2018) Dear NHTSA Officer: On June 12, 2021, at approximately 4PM, my sister [XXX]was KILLED while riding her motorcycle along with her pleasure motorcycle group. While preparing to make a legal left turn from CO State Highway 69 on to Route 1A (38.30908° N 105.62018° W) my sister [XXX] was struck from behind, by a 2016 Dodge Ram Truck traveling 61-64 MPH with activated Cruise Control. In Fremont County Court hearing Jan. 30, 2021, the driver [XXX] referred to the judge, that he was unable to deactivate his 2016 Dodge Ram 1500 cruise control, thereby causing the DEATH. In open court [XXX] referred to cruise control RECALL NHTSA Campaign #18V332000 and FAILED Dodge Ram Campaign #U53 that discounted proper repairs ORDERED in the original NHTSA SAFETY RECALL #18V332000. IT APPEARS, that the disregard for proper repairs to be carried out on the cruise control system amount to MURDER of my sister [XXX] at the hands of Chrysler, Ram Trucks, and FCA US LLC. INVESTIGATION NEEDS TO BE OPENED on HOW or WHY GEICO Insurance ([XXX]'s Auto Ins. policy #[XXX]) declared his 2016 Dodge Ram 1500 SLT Quad Cab 4X4 with approximately value of (at time of crash - June 12, 2021) $33,000, a total loss. THE EXACT DAY, a Saturday after the 4PM crash. Per Car Fax and notes from the court regarding release of the 2016 Dodge Ram 1500 Truck. The truck was CRUSHED - EXACTLY 6 months +1 day after the crash. IMPORTANT TO NOTE, that Both Trooper [XXX] (C.S.P. Investigator with 26 years of service) was FIRED for "DISHONESTY" and his supervisor was also fired likely for same cause. Engine speed surged while pulling into parking space. Bringing to dealer to have checked. No warning, or codes given. $1500 in damages to my vehicle and probably the same to the parked car in front of me. Worried about my safety now with this sudden acceleration.

ON JULY 5TH, 2019 I WAS DRIVING DOWN I-95 FROM BEAUFORT SC TO JACKSONVILLE, NC GOING 75MPH. I HAD BEEN USING MY CRUISE CONTROL FOR ABOUT AN HOUR AND TRAFFIC WAS PRETTY BUSY BUT I WAS STILL ABLE TO MAINTAIN A SAFE DISTANCE AND CONTINUE USING MY CRUISE CONTROL. AS IT OFTEN DOES IN THE CAROLINAS, IT BEGAN TO LIGHT RAIN SO I ATTEMPTED TO SLOW DOWN MY SPEED. AS I DEPRESSED THE BREAK, I LOST CONTROL OF MY TRUCK, POSSIBLY DUE TO THE BEGINNING OF WATER ACCUMULATION ON THE ROAD, BUT MY CRUISE CONTROL WOULD NOT COME OFF AND I COULD NOT STOP. I ENDED UP RUNNING OFF THE ROAD, SPINNING 3 TIMES AND FINALLY STOPPING BACKWARDS IN THE TREES SEPARATING 95 NORTH AND SOUTH. DUE TO MY VEHICLE BEING TOO FAR TO TOW, I HAD TO DRIVE IT 200 MILES BACK AND WHEN I TOOK IT TO GET FIXED WITH MY INSURANCE ADJUSTER, THEY PULLED MY BLACK BOX WHICH SHOWED THE CODES C0051-28, C006A-62 AND U0415-00. I WAS INFORMED MY VEHICLE HAD ABOUT 9 RECALLS SUCH AS 18V332000 SO I HAD TAKEN MY TRUCK TO THE DODGE DEALER IN NOVEMBER OF 2018 TO HAVE ALL OF THE RECALLS FIXED. I WAS TOLD BY THE MECHANIC WHO FIXED MY TRUCK AFTER MY ACCIDENT, THAT THE CODES WERE SHOWING AN ISSUE WITH MY CRUISE CONTROL WHICH MADE SENSE, SEEING HOW I COULD NOT TAKE IT OFF OR USE MY BREAKS TO SLOW DOWN AND ENDED UP HITTING THE TREE LINE STILL GOING 75MPH AND COSTING OVER $13,600. I JUST WANTED TO MAKE SURE THE MANUFACTURER KNEW THAT THE ISSUES ARE STILL OCCURRING.

WHILE TRAVELING ON I-5 SOUTH AT APPROX. 65 MPH, USING THE CRUISE CONTROL, THE VEHICLE SUDDENLY SPED UP AND THE DRIVER WAS UNABLE TO DECREASE THE SPEED OF THE VEHICLE CAUSING THE DRIVER TO VEER WEST OFF INTO THE DIRT SHOULDER STRIKING THE DIRT EMBANKMENT AND WOOD FENCE. THE DRIVER SUSTAINED MAJOR INJURIES TO HIS FACE, ANKLE AND PAIN IN CHEST. *BF *TR THE CONSUMER STATED THE VEHICLE WAS SCRAPED BEFORE INFORMATION FROM THE COMPUTER WAS RECEIVED. THE DRIVER BECAME DISABLED AND COULD NO LONGER WORK. *JS

TL* THE CONTACT OWNS A 2016 RAM 1500. WHILE THE DRIVER WAS MAKING A LEFT TURN INTO A PARKING LOT, THE VEHICLE ACCELERATED INDEPENDENTLY WITHOUT WARNING, THE CONTACT DEPRESSED THE BRAKE PEDAL, BUT THE VEHICLE FAILED TO STOP. AS A RESULT, THE DRIVER CRASHED INTO A PARKED VEHICLE. THE AIR BAGS FAILED TO DEPLOY. IN ADDITION, THE DRIVER HAD TO REMOVE THE KEY FROM THE IGNITION SWITCH IN ORDER FOR THE VEHICLE TO STOP. THERE WERE NO INJURIES AND A POLICE REPORT WAS FILED. THE VEHICLE WAS TOWED TO PARKWAY CHRYSLER (LOCATED AT 21560 HALL RD, CLINTON TOWNSHIP, MI 48038). THE VEHICLE WAS NOT DIAGNOSED OR REPAIRED.
