TL* THE CONTACT OWNED A 2012 NISSAN ROGUE. WHILE DRIVING 40 MPH, THE BRAKE PEDAL WAS DEPRESSED BUT FAILED TO RESPOND WITHOUT WARNING. THE CONTACT'S VEHICLE REAR ENDED ANOTHER VEHICLE. THE AIR BAGS DID NOT DEPLOY. A POLICE REPORT WAS FILED. THE CONTACT SUSTAINED BRUISING TO HER CHEST AND A HAIRLINE FRACTURE TO THE RIGHT KNEE. MEDICAL ATTENTION WAS REQUIRED. THE VEHICLE WAS NOT DIAGNOSED OR REPAIRED. THE FAILURE MILEAGE WAS APPROXIMATELY 35,000. THE VEHICLE WAS DESTROYED AND TOWED. THE VIN WAS NOT AVAILABLE.
